ETA Submits Comments Regarding the CFPB’s Proposed Arbitration Rules

August 22, 2016

Dear Ms. Jackson:
The Electronic Transactions Association (“ETA”) hereby respectfully submits its comments in response to the Consumer Financial Protection Bureau’s (“Bureau”) above-captioned Notice of Proposed Rulemaking (“NPRM”) on arbitration. ETA submits that the proposed rules should not be adopted because the Bureau’s findings that the rules will protect consumers and serve the public interest are not consistent with the Arbitration Study that the Bureau conducted pursuant to the Dodd-Frank Act. As a result of this inconsistency, adoption of the rules as currently drafted would not comply with the statutory mandate
